PREAMBLE

These Terms of Service (the "Terms") govern access by visitors to https://weco.nexaxt.com and its subdomains (the "Site") and the manner of interacting with the Site's information materials. These Terms supplement, but do not replace, the Public Offer and EULA, which govern licensing of the WECO software.

By using the Site, you agree to these Terms. If you disagree, stop using the Site.

1. SITE OWNER

1.1. The Site is owned and operated by NEXA IKS TI LLP (BIN 230940021527), 050013, Republic of Kazakhstan, Almaty, Bostandyk district, Seifullin Avenue, building 617 (the "Company", "We").

1.2. The Site is an internet resource within the meaning of RK Law No. 418-V of 24 November 2015 "On Informatization" and RK Law No. 567-II of 5 July 2004 "On Communications".

2. INTELLECTUAL PROPERTY

2.1. All Site materials (text, graphics, logos, video, page code, layout, design, databases) are intellectual property of the Company or used under license, protected by RK law and international treaties.

2.2. Use of Site materials without the Company's written consent is prohibited, except: (a) good-faith citation with attribution; (b) use of WECO open-source code under FSL 1.1; (c) use of materials marked "Free to use" or under Creative Commons.

2.3. "WECO", "NexaXT" trademarks and logos are the Company's property; no use without consent.

3. ACCEPTABLE VISITOR CONDUCT

3.1. Visitors shall not: (a) attempt unauthorized access to closed sections, databases, servers; (b) use automated tools (scrapers, bots) creating excessive load; (c) upload malware or attempt to exploit vulnerabilities; (d) post (via contact / support forms) defamation, insults, threats, illegal content; (e) impersonate another person; (f) violate applicable law.

3.2. The Company may block IPs and accounts violating §3.1, without notice.

4. REGISTRATION AND ACCOUNTS

4.1. Some Site features (license management, support) require registration.

4.2. By registering you: (a) provide accurate data; (b) keep them current; (c) maintain password confidentiality; (d) bear responsibility for all actions under your account.

4.3. The Service is not offered to persons under 18. Such accounts are blocked immediately on detection.

5. EXTERNAL LINKS

5.1. The Site may link to third-party resources (GitHub, Stripe/FreedomPay, Next.js docs, etc.). The Company is not responsible for their content or availability.

5.2. Following links is at the visitor's risk.

6. SITE CHANGES

6.1. The Company may at any time: (a) add, change, remove materials and features; (b) change structure and URLs; (c) suspend access for maintenance.

6.2. The Company is not liable for temporary unavailability.

7. PERSONAL DATA. COOKIES

7.1. Processing of visitor personal data is governed by the Privacy Policy (https://weco.nexaxt.com/pages/privacy-policy-en.html).

7.2. Cookies are governed by the Cookie Policy (https://weco.nexaxt.com/pages/cookie-policy-en.html).

8. DISCLAIMER OF WARRANTIES

8.1. The Site is provided "AS IS" and "AS AVAILABLE". The Company does not warrant: (a) uninterrupted operation; (b) error-free operation; (c) point-in-time accuracy of all information (we do strive to keep current); (d) compatibility with every browser / device.

8.2. Information on the Site is for reference only and is not: (a) legal advice; (b) financial advice; (c) tax advice; (d) investment recommendation.

8.3. Consult qualified professionals before acting on Site information.

9. LIMITATION OF LIABILITY

9.1. To the maximum extent permitted by applicable law, the Company is not liable for: (a) visitor losses arising from use of the Site; (b) Site unavailability or malfunction; (c) accuracy of third-party resources linked from the Site; (d) third-party actions on the Site (e.g., via contact forms).

9.2. Aggregate Company liability under these Terms is capped at USD 1,000 equivalent.

10. CONSUMER RIGHTS

10.1. If a visitor is a consumer (natural person) within the meaning of RK Law No. 274-IV of 4 May 2010 "On Consumer Protection", non-derogable consumer rights are not limited by these Terms.

11. GOVERNING LAW AND FORUM

11.1. RK law applies.

11.2. Forum: Specialized Inter-District Economic Court of Almaty. Arbitration and class actions excluded. Full provisions in Public Offer §14.

11.3. Mandatory pre-trial claim — 30 days. Send to anton.orlov@nexaxt.com.

12. AMENDMENT

12.1. The Company may amend these Terms. The new version is published on this page with an effective date.

12.2. Continued Site use after publication = consent.
